Within FYEO, your medical and private personal data are collected and recorded in your electronic medical record. This is necessary to facilitate our care and/or assistance to you. Your personal data are processed in accordance with the General Data Protection Regulation (GDPR) and the Medical Treatment Contracts Act (WGBO). These laws describe your rights and obligations regarding your client file and the manner in which employees of our clinic must handle your personal data.

In this statement, we inform you about the way in which we process your personal data. We consider your privacy to be very important. Therefore, we handle your personal data with care.
What is personal data?
Personal data is any information that can provide information about an identifiable natural person. Medical practitioners are required to set up a medical record. This record only contains data about your health and treatment that are necessary for proper care and assistance.
Why do we process your personal data?
Within FYEO, personal data are processed to provide the correct care, treatment, and aftercare.
This includes information about your state of health, test results, diagnoses, treatment plans, surgical reports, and other data necessary for proper care. The processing and use of personal data are subject to strict rules. If we process personal data or have third parties process data on behalf of FYEO, we make clear agreements about this in a processing agreement and ensure proper security of the data.
FYEO is required to set up a medical record. This record only contains data about your health and treatment that are necessary for proper care.
In addition, FYEO processes personal data for:
- quality monitoring and improvement of care;
- investigating complaints and incidents;
- financial settlement of care and assistance and maintaining our administration;
- demonstrating to other authorities, including government agencies, that FYEO complies with agreements made and applicable laws and regulations;
- concluding and executing loans for the purpose of financing your treatment, which is carried out by a third party on behalf of FYEO;
- relationship management, promotional, and marketing purposes. This includes answering and following up on brochure and preliminary examination requests, scheduling a preliminary examination, and measuring and optimizing our online campaigns, as further explained in this privacy statement.
What data do we collect from you?
To provide proper care, FYEO collects personal data. We use your name, address, contact details, gender, date of birth, BSN number (citizen service number), medical data regarding your desired treatment, medication overview, and other data necessary in the context of the treatment.
When you request a brochure via our website, make a request for a preliminary examination, or contact us in any other way, we may process the data you provide to us yourself. This may include your name, email address, telephone number, postal code, city, and the information necessary to process your request.
What happens to your personal data?
The basic rule is that FYEO handles your personal data with care. Your personal data are only processed by persons who need them in view of their tasks and powers. They are bound by confidentiality. In the processing of personal data, no more data are included than is necessary for the purpose of the processing.
FYEO may only process your personal data if:
- you have given your consent for the processing;
- the data processing is necessary for the performance of a contract;
- the data processing is necessary to comply with a legal obligation to which FYEO is subject;
- the data processing is necessary to protect a vital interest of you or another natural person;
- the data processing is necessary for the purposes of a legitimate interest.

Ad measurement and campaign optimization
FYEO uses online advertising platforms such as Google and Meta. To see how well our campaigns are working and how we can improve them, we may share data such as your email address and phone number with these platforms.
Before we share this data, we make it unidentifiable (we encrypt it). As a result, it cannot be traced directly back to you. The data is only used to measure how effective advertisements are and to improve them.
We do not share medical information or details about your treatment. Think of things such as the type of treatment, medical results, or other personal information – those remain private.
We only share the data that is truly necessary for ad measurement, such as your email address and phone number, and nothing more.
Use of cameras
At some FYEO locations, surveillance cameras are present on and around our premises to ensure our and your safety. In addition, FYEO uses live video images in the operating rooms. These images are not recorded, stored, and/or processed, but serve only to promote the treatment process and the flow of clients.
Recording of telephone calls
Telephone calls with our employees may be recorded for quality and training purposes. These recordings help us to continuously improve our services and optimize your experience as a client. Should you have any objection to this, you can indicate so.
The recorded calls are stored securely and only made accessible to authorized employees. We treat all data confidentially and in accordance with applicable privacy legislation. The recordings are kept no longer than is necessary for the aforementioned purposes.
Do you not wish to be contacted by FYEO?
After leaving your details following a request for a brochure or preliminary examination, FYEO may contact you by email with additional information about our treatments, the possibility of scheduling a free and non-binding preliminary examination, or the further follow-up of your request.

How do we protect your data?
FYEO employees are committed to treating and guiding you as a client as well as possible. Nevertheless, it may happen that you have a negative experience or that FYEO does not meet your expectations regarding your privacy protection.

How long do we keep your data?
The collected data are kept no longer than necessary for the purpose of the processing. FYEO keeps your medical data because it may be relevant for future eye treatments.
Data used for handling and following up on requests, relationship management, promotional and marketing purposes, and ad measurement are kept no longer than is necessary for these purposes or as long as legally permitted.
What are your rights?
You have the right to access and a copy of the personal data that FYEO has processed about you. If you believe that those personal data are not or no longer complete, you can object to the personal data processing, submit a request to supplement, improve, rectify, or delete your personal data, or submit a request to restrict your personal data processing. In addition, you have the right to have your personal data transferred to a third party.

What (medical) information is shared with third parties?
FYEO may share medical information with other healthcare providers directly involved in your treatment. This is only allowed if that information is necessary for providing proper care. You do not need to give permission for this. You can, however, object to it. In that case, FYEO may no longer pass on information to other healthcare providers.
How do we secure your personal data?
FYEO has taken appropriate technical and organizational measures to secure personal data against loss or against any other form of unlawful processing.
Microsoft Office Message Encryption
Sometimes it is necessary to send or receive medical data by email. To send this email, we use a secure email service: Microsoft Office Message Encryption. This ensures that the medical data we share with you is protected. Only you can view this email. You will receive an encrypted message from us, in which you gain access to the information by means of a code that you receive in a separate email. The use of a secure email service is mandatory when sharing medical data.
How do we report data breaches?
Should any form of loss or unlawful use of personal data unexpectedly occur, FYEO uses the procedure for data breaches. This describes the steps we take to investigate the data breach, limit the damage as much as possible, and the way in which we keep you as a stakeholder informed.
Do you have a complaint about the protection of your personal data?

It is also possible to submit your privacy complaint to the Dutch data protection authority. This is the Autoriteit Persoonsgegevens.
