Privacy statement

Within FYEO, your medical and personal details are collected and recorded in a digital medical file. This is necessary to enable us to provide you with medical care and support. Your personal data is processed in compliance with the General Data Protection Regulation (GDPR) and the Dutch Medical Treatment Contracts Act (WGBO). These laws describe your rights and obligations regarding your client file and how staff at our clinic handle your personal data.

FYEO respects your privacy

In this statement, we explain how we process your personal data. Your privacy is very important to us. We therefore handle your personal data with great care.

What is personal data?

Personal data is all the information related to an identifiable natural person. Medical staff are required to create a medical file. This file only contains information about your health and about the procedure which is necessary to provide good medical care and support.

Why do we process your personal data?

At FYEO, personal data is processed so that we can offer the appropriate care, procedure and after care.

Your health status, examination results, diagnosis, procedure plans, surgery reports, etc. The processing and use of personal data is governed by strict rules. If we process or instruct others to process personal data on behalf of FYEO, we record this in a processing agreement.

For all data processing, we record what information is processed, who is involved and what security measures have been taken. FYEO is required to create a medical file. This file only contains information about your health and the procedure which is necessary to provide good medical care.

FYEO also processes personal data for:

  • Quality assurance and improvement of the medical care.
  • Investigations into complaints and incidents.
  • Financial settlement of the medical care and support and to update our administration.
  • Providing evidence to other (government) bodies that FYEO complies with the agreements reached and applicable legislation.
  • Arranging and administering loans to finance your procedure, which are managed by a third party for
    FYEO.
  • Relationship management, promotion and marketing goals.

What data do we collect about you?

To be able to provide good medical care, FYEO collects personal data. We use your name, address, contact details, gender, date of birth, BSN number, medical information relating to your desired procedure, medication overview and other information required for the procedure. If the personal data is not provided directly by you but by third parties/organisations, we will provide details of the source.

How is your personal data used?

The basic rule is that FYEO handles your personal data with great care. Your personal data is only processed by people who need this information to perform their tasks and authorisations. They are bound to strict confidentiality. The processing of personal data only involves information that is required for the purpose of the processing. When data is processed for other purposes, we expressly ask you separately for your consent.

FYEO may only process your personal data if:

  • You have given consent for that data to be processed.
  • The data processing is necessary to implement a contract.
  • The data processing is necessary to comply with a legal obligation to which FYEO is subject.
  • The data processing is necessary to safeguard a vital interest of you or another natural person.
  • The data processing is necessary to promote the legitimate interest.

When you provide personal data on our website(s) to request information, we will only use this information to handle your request. Your data will not be used for any other purposes and will never be shared with third parties outside FYEO.

Use of cameras

In some FYEO locations, surveillance cameras are installed in and around our sites to safeguard our and your safety. Furthermore, FYEO uses live video recordings in the operating rooms. These images are not recorded, saved and/or processed, but are only aimed at improving the procedure process and throughput of clients.

Recording of telephone calls

Telephone calls with our staff may be recorded for quality and training purposes. These recordings help us continually improve our services and optimise your experience as a client. If you have any objection to this, you may let us know.

The recorded conversations are saved securely and may only be accessed by authorised staff. We handle all information confidentially and in compliance with the applicable privacy legislation. The recordings are not kept for longer than is necessary for the above-mentioned purposes.

Would you rather not be contacted by FYEO?

After leaving your details when requesting a brochure, FYEO may contact you by telephone or e-mail to offer you a free, no-obligation preliminary examination. If you would rather not be contacted, send us an e-mail with your first name, surname, postcode and town/city to clientenvoorlichting@fyeo.nl.

How do we protect your data?

FYEO staff are committed to providing our clients with the best possible treatment and support. However, it is possible that you have a negative experience or that FYEO does not fulfil your expectations with respect to protecting your privacy. The Data Protection Officer is the external contact person for FYEO for the protection of your privacy.

Microsoft Office Message Encryption

Sometimes it is necessary to send or receive medical data by e-mail. To send this e-mail, we use a secure e-mail service: Microsoft Office Message Encryption. This ensures the security of the medical data we share with you. Only you can read this e-mail. We send you an encrypted message in which you are given access to the information by means of a code which we send in a separate e-mail. Using a secure e-mail service is compulsory when sharing medical data.

How long do we keep your data?

The collected data is not kept for longer than required for the purpose of the processing. The personal data in your client file is kept for 20 years, as required by law.

What are your rights?

You have the right of access and to receive a copy of your personal data that FYEO has processed. If you feel that the personal data is not or no longer complete, you may object to the personal data processing, submit a request to supplement, improve, rectify or delete your personal data, or, submit a request to restrict the processing of your data. You also have the right to transfer your personal data, or have it transferred to a third party.

What (medical) information is shared with third parties?

FYEO may share (medical) information with other medical care providers who are directly involved in your procedure. This is only permitted if that information is necessary to provide good care. You do not need to provide consent. However, you may object. In that case, FYEO may not share information with other care providers.

How secure is your personal data?

FYEO has taken appropriate technical and organisational measures to secure personal data from loss or from any other form of unlawful processing.

How do we report data breaches?

If some form of loss or unlawful use of personal data does unfortunately take place, FYEO applies the procedure for data breaches, which describes which steps we take to investigate the data breach, minimise the damage and how to update you as a party concerned.

Do you have a complaint about the protection of your personal data?

For complaints, you can contact FYEO at info@fyeo.nl or the Data Protection Officer at adevos@qvox.nl.

You can also submit your privacy complaint to the Dutch Data Protection Supervisor. This is the Dutch Data Protection Authority (Autoriteit Persoonsgegevens, AP).
